Terms of Service

The agreement between you and Martimart Ltd when you use Marti.

Effective April 20, 2026

These Terms cover three kinds of users: brands who install Marti on their store, creators who run a Marti-powered storefront, and shoppers who buy through Marti Direct. Where a section only applies to one of these, it says so.

We've tried to keep this plain-English. The defined terms you'll see most: Marti (the product and platform), Martimart or we/us (Martimart Ltd, company number 517110128, registered in Israel), and you (the person or company using Marti).

1. The agreement

By creating an account, installing Marti on your store, or using Marti Direct, you agree to these Terms and to our Privacy Policy. If you're agreeing on behalf of a company, you're confirming you have the authority to do so.

If you don't agree, please don't use Marti.

2. Who this is for

Brands

Marti plugs into your ecommerce store and assists your shoppers in real time. You remain the merchant of record for everything sold on your store. Marti is a tool you run on your own infrastructure and customer base.

Creators

You curate products; Marti powers the storefront and the shopping assistant. Depending on the plan you choose, you either pay a subscription or share a percentage of sales with us. Fulfillment is handled by the third-party merchants behind the products (for example, Amazon or Alibaba sellers).

Marti Direct shoppers

Marti Direct is our own collection of curated shopping experiences. We are an affiliate, not the seller: when you check out, your purchase contract is with the underlying merchant (for example, Amazon or Alibaba), and their terms, shipping, warranty, and refund policies apply. See Section 8 for detail.

3. Your account

You're responsible for keeping your login credentials safe and for everything that happens under your account. Tell us at marti@martimart.com if you suspect unauthorized access.

You must be at least 16 years old to create an account. If you're using Marti on behalf of a company, you're confirming you're authorized to bind it to these Terms.

4. Acceptable use

Don't use Marti to do anything illegal, harmful, or abusive. Specifically, you agree not to:

  • Sell products or services that are illegal in the jurisdictions you sell to (including but not limited to: regulated drugs, weapons, stolen goods, items that infringe IP).
  • Use Marti to deceive shoppers — fake reviews, bait-and-switch pricing, misleading health or financial claims.
  • Send the AI prompts designed to extract system instructions, sub-processor keys, or other users' data.
  • Reverse-engineer, scrape, or rebuild Marti, or use it to train a competing product.
  • Interfere with the platform's operation — rate-limit evasion, vulnerability probing outside a responsible-disclosure channel, denial-of-service traffic.
  • Upload content you don't have the right to use, or content that is defamatory, hateful, or sexual material involving minors.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

5. Your content and data

You keep ownership of your product catalog, brand assets, customer data, and anything else you upload to or connect with Marti (Your Content). You grant us a limited, worldwide, royalty-free license to host, process, display, and transmit Your Content for the sole purpose of providing Marti to you.

We may generate aggregated, de-identified analytics — for example, how often a category of product is shown, or how many shoppers clicked a recommendation — and use that data to operate and improve Marti. Aggregated data never identifies you, your shoppers, or your products individually.

6. The service

We work hard to keep Marti available and performing well. For paid plans we target 99.9% monthly uptime, excluding scheduled maintenance (which we announce in advance) and events outside our reasonable control. Free-tier availability is provided as-is.

We may update, add, or remove features over time. We won't materially degrade features you're actively using on a paid plan without notice and, where appropriate, a prorated refund or migration path.

7. Fees and billing

Current pricing is at /pricing. Paid plans are billed in advance on a monthly or annual cycle through our payment processor, Paddle. You authorize us to charge the payment method on file.

Prices are in US dollars and exclusive of taxes unless stated otherwise. Paddle acts as the merchant of record for SaaS subscriptions and collects applicable VAT/GST/sales tax at checkout.

If payment fails, we'll retry and email you; after 30 days of non-payment we may suspend or cancel the plan. Refunds and cancellations are governed by our Refund Policy at /refund.

8. Marti Direct (affiliate disclosure)

Marti Direct storefronts are shopping experiences that we design and operate, but the products are fulfilled by third-party merchants — primarily Amazon and Alibaba sellers — and we earn an affiliate commission when you buy.

This matters because Martimart is not the seller. When you click through to check out, you're purchasing from the underlying merchant under their terms. Their policies govern:

  • Payment processing and the merchant of record for the sale.
  • Shipping, delivery times, and tracking.
  • Product warranty and post-purchase support.
  • Returns, refunds, and exchanges (see our Refund Policy for how this interacts with our service).

We curate honestly and disclose the affiliate relationship on every Marti Direct surface. We're not liable for product quality, availability, or post-purchase issues on the merchant's side, but we'll do our best to help you find the right person to talk to if something goes wrong.

9. Privacy

Our Privacy Policy at /privacy explains what personal data we collect, how we use it, and the rights you have under GDPR, CCPA, and Israel's Privacy Protection Law. It's part of these Terms.

If you're a brand or creator on a paid plan processing EU personal data through Marti, a Data Processing Addendum (DPA) applies and forms part of this agreement. Request a countersigned copy by emailing marti@martimart.com.

10. Intellectual property

We own Marti — the software, the models, the UI, the brand, the docs. These Terms grant you a non-exclusive, non-transferable license to use Marti while your account is in good standing. You own Your Content, as described in Section 5.

You may send us feedback and feature ideas. If you do, we're free to act on them without obligation to you, including building them into Marti.

11. AI and model training

Marti uses large language models and related AI systems from providers including OpenAI, Anthropic, and Google to generate responses. These providers process inputs on our behalf under their enterprise agreements; they don't train their public models on your data.

We do use data generated through Marti to improve our own systems — for example, tuning the assistant's behavior, evaluating recommendation quality, and training Marti-specific models. We de-identify and aggregate data before using it for training. You can opt out of training on your data by emailing marti@martimart.com; brands on Enterprise plans can also set this by default in their DPA.

AI outputs can be wrong. Don't rely on Marti for medical, legal, or financial advice. If an AI response misrepresents a product or makes an unsupported claim, please report it to us.

12. Disclaimer of warranties

Marti is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or use of trade. Nothing in this section limits rights that cannot be waived under your local law.

13. Limitation of liability

To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, or data, arising out of or related to these Terms — even if advised of the possibility.

Our total aggregate liability for any claim arising out of these Terms is capped at the greater of (a) the fees you paid us in the 12 months before the claim, or (b) US$100. These caps apply in the aggregate, not per incident.

Some jurisdictions don't allow the exclusion of certain damages or limits on liability — if you're in one, the limits in this section apply to you only to the extent permitted.

14. Indemnification

If you're a brand or creator, you agree to defend and indemnify Martimart against third-party claims arising out of Your Content, your products, or your use of Marti in breach of these Terms. We'll tell you promptly about the claim and let you control the defense, provided you don't settle in a way that admits liability on our behalf without consent.

15. Termination

You can cancel at any time from your account settings. On the free tier, cancellation is immediate. On paid plans, cancellation takes effect at the end of the current billing period — you keep access until then.

We can terminate or suspend your account with reasonable notice for any reason, or without notice if you materially breach these Terms, if required by law, or to protect the platform and other users. We'll give you 30 days to cure a curable material breach before terminating for cause.

On termination: your license to use Marti ends; we may delete Your Content after a reasonable grace period (we aim for 30 days) during which you can export it; the sections of these Terms that by their nature should survive — ownership, liability, indemnification, governing law — survive.

16. Changes to these Terms

We may update these Terms. If the change is material, we'll email account holders and post a notice in the product at least 14 days before it takes effect. If you don't agree with a change, you can cancel before it takes effect.

17. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

If you're a consumer located in the EU, the UK, or another jurisdiction that grants you rights that can't be contracted away, nothing in this section limits those rights.
